I think it would be hard to determine as it traditionally was in the first 3 sections for a long time but it was later changed as people would "sit out" a section as they knew it was experimental.

I would contact the Bar Association in your state to see if you would be able to pass the character and fitness portion. You might have to wait for 5 years or more, not sure about this.
